Rule 46
Expert Committee
(1) According to sub-section (3) of section 72 of the Act, there will be an expert committee as follows to decide whether a wrong health examination report has been given or not:-
(a) Eleventh or twelfth level doctor designated by the Ministry of Health and Population - Chairman
(b) Physician appointed by Nepal Medical Council – Member
(c) Law Officer of the Ministry of Labor and Transport - Member
(c) Director of Foreign Employment Board -- Member
(d) President or representative of Nepal Health Professionals Federation - Member
(e) A person designated by the Ministry of Labor and Transport from among those who have returned from foreign employment - member
(f) President of the official trade union or his designated representative one – member
(2) The expert committee formed according to sub-rule (1) may, if deemed necessary, invite the expert of the relevant subject to participate as an observer in the meeting of the committee and take opinion consultation.
(3) The chairman and members of the expert committee constituted as per sub-rule (1) shall receive the meeting allowance as specified by the board.
(4) The expert committee formed according to sub-rule (1) may form a sub-committee consisting of experts in the relevant subject to carry out any work it is required to do in accordance with the Act or this regulation.
(5) The procedure related to the meeting of the expert committee constituted as per sub-rule (1) shall be as determined by the committee itself.
(6) The work of the secretariat of the expert committee under sub-rule (1) will be done by the law branch of the Ministry of Labor and Transport.
